
Telemedicine Policy

1. Introduction
Tr 2nd Opinion provides video-based doctor consultations in compliance with the Telemedicine Practice Guidelines, 2020, issued by the National Medical Commission (NMC), India. This policy defines the legal, ethical, and operational framework governing telemedicine services.
2. Definition of Telemedicine
Telemedicine refers to the remote diagnosis, treatment, and consultation provided by registered medical practitioners (RMPs) via video conferencing, chat, or voice calls.
3. Scope of Services
Tr 2nd Opinion allows patients to:
- Consult licensed medical professionals via video calls.
- Receive digital prescriptions where permitted.
- Seek second opinions from specialists.
- Obtain guidance on non-emergency medical conditions.
⚠️ Telemedicine is NOT a substitute for emergency care. In case of emergencies, users should call 108 or visit the nearest hospital.
4. Eligibility & Consent
- Patients must be 18 years or older to use the service.
- Minors require parental/guardian consent for consultations.
- Patients must provide explicit consent before a consultation begins.
5. Doctor Qualification & Registration
- Only Registered Medical Practitioners (RMPs) licensed under the National Medical Commission (NMC) Act, 2019, are allowed to provide consultations.
- Doctors must disclose their NMC registration number to patients.
6. Permissible Consultations
✅ Allowed via Telemedicine:
- General health advice.
- Management of chronic diseases (diabetes, hypertension, etc.).
- Follow-up consultations for ongoing treatments.
- Mental health counseling.
- COVID-19-related consultations.
❌ NOT Allowed via Telemedicine:
- Emergency consultations requiring immediate physical intervention.
- Prescription of Schedule X drugs (e.g., habit-forming medications, narcotics).
- Abortion or termination of pregnancy-related consultations (as per the MTP Act, 2021).
7. Prescription Policy
- E-prescriptions are provided as per Telemedicine Guidelines, 2020.
- No prescriptions for narcotics or habit-forming drugs.
- Doctors can only prescribe medicines from List A (permitted drugs under Telemedicine Guidelines).
8. Data Confidentiality & Security
- All patient records, prescriptions, and consultation details are securely stored and encrypted.
- Tr 2nd Opinion does not record video consultations to ensure patient privacy.
- Data handling complies with DPDP Act, 2023, and the IT Act, 2000.
9. Fees & Payment Policy
- Patients must pay the consultation fee before the session starts.
- Payments are processed through an RBI-compliant payment gateway.
- Refunds are governed by our Refund & Cancellation Policy.
10. Patient Responsibilities
Patients using Tr 2nd Opinion must:
- Provide accurate medical history for effective consultation.
- Follow doctor instructions and seek in-person care if advised.
- Not misuse or harass doctors, or risk being permanently banned.
11. Doctor Responsibilities
Doctors consulting on Tr 2nd Opinion must:
- Follow ethical medical practices and guidelines.
- Provide clear, evidence-based medical advice.
- Maintain patient confidentiality and protect medical data.
- Avoid overprescription or prescribing unauthorized medicines.
12. Limitation of Liability
- Tr 2nd Opinion provides advisory medical consultations only.
- We do not guarantee specific health outcomes from consultations.
- We are not liable for any misdiagnosis or adverse outcomes.

14. Governing Law & Dispute Resolution
